Privacy policy

Last updated 8 October 2026 (version 1.10). This policy explains how Yamu Aryal (ABN 20 230 614 458), who runs Gentle Everyday Moments ("GEM", "we"), handles personal information in the GEM Creators app, in line with the Australian Privacy Principles.

What we collect

Brands and buyers

If you contact us through our licensing page, we collect your name, company, email and message, and use them only to reply and to arrange licensing or commissioned footage. We keep enquiries for up to 2 years.

Marketplace buyers

Buyers join by invitation only; we never create an account from an enquiry. Buyer accounts hold your name, company, email, phone, the briefs you post and when you accepted the buyer terms. To protect creators' work, previews show the viewer's email as a watermark and we log which previews each buyer views. Creators' names and contact details are never shown to buyers.

Why we use it

To run your account, review and publish your submissions, calculate and pay your revenue share, prepare your statements, run the in-app leaderboard, meet our tax and legal obligations, keep the service secure, and contact you about your submissions and payments. We do not sell your personal information. Account, payment and upload details are not used for advertising. Page visits are measured with the Meta Pixel, described under Cookies, so we can see how people find the site, including from ads.

Videos we publish

Accepted footage is published on GEM's channels and pages on YouTube, Facebook, Instagram, TikTok, Pinterest and similar platforms, where it is public and also subject to those platforms' own privacy policies. We never publish creators' names or contact details with a video unless you ask us to. We don't publish the name of anyone who appears in a video, or anything that identifies where they live.

Children

Creators and buyers must be 18 or over. Children sometimes appear in footage; when they do, we only accept it with a parent's or guardian's signed consent, and we treat the child's best interests as the first consideration:

Where it is stored

The app runs on Cloudflare (database and file storage), and sign-in and analytics use Google; Facebook and Instagram figures come from Meta. Page-visit measurement uses Meta's Pixel, which may store data in the United States. These providers may store data outside Australia, including in the United States. Only GEM administrators can see your details, payment details and uploads.

The leaderboard

Signed-in creators can see a leaderboard of the top videos and creators for this week, this month and last month. It shows your first name and last initial, the titles of your published videos (which are already public on YouTube), their views and the share they earned, plus monthly awards (best performing, most viewed and top growth). You can hide your name, so you appear as "A GEM creator", by unticking the leaderboard option in your profile.

How long we keep it

We keep account, agreement and payment records for as long as you have an account and then for 7 years for tax purposes. Footage we do not accept is deleted on request or within 12 months. Footage we publish is kept as part of GEM's content library.

If something goes wrong

If we become aware of a data breach that is likely to cause serious harm, we will contain it, assess it promptly (within 30 days), and notify the people affected and the Office of the Australian Information Commissioner as the Notifiable Data Breaches scheme describes.

Your choices: access, correction and deletion

We respond within 30 days. When we delete your information we keep only what the law requires: payment, earnings, tax and invoice records and signed agreements (kept for 7 years), and footage GEM accepted, which GEM owns under the creator agreement. Footage we never accepted, with any consent forms for it, is deleted. If we can't do what you asked, we will tell you why. Every request and what we did is recorded.

If you are unhappy with how we handled a privacy matter, contact us first; you can also complain to the Office of the Australian Information Commissioner (oaic.gov.au).

Cookies

We use one essential cookie to keep you signed in. We also use the Meta Pixel on our pages to record page views. Meta may set its own cookies and receive your IP address, browser details and the pages you view, including so we can measure visits that come from our ads. Meta's own policy is at facebook.com/privacy/policy. If your first visit includes a campaign link or an ad click id, we remember that in a cookie on this site for 90 days and, if you then create an account, store it with your account. Administrators can see it on the Leads page. It is deleted with the rest of your profile if you ask us to delete your account data.
